A renowned orthopedic surgeon married to a popular daytime television personality finds himself increasingly isolated in a massive insurance fraud case.

According to Daily Mail, Dr. Emmanuel Hostin, husband of The View co-host Sunny Hostin, now stands alone in his legal battle as most co-defendants have agreed to settle in a $450 million lawsuit filed by American Transit Insurance Company.

The insurance company announced that 141 out of 186 defendants named in the suit have reached settlement agreements. This development leaves Dr. Hostin in a precarious position as he maintains his innocence against allegations of providing fraudulent medical services in exchange for kickbacks.

Multiple defendants settle while Hostin maintains innocence

The lawsuit identifies Dr. Hostin as the owner of Hostin Orthopedics & Sports Medicine in midtown Manhattan. He faces accusations of knowingly providing fraudulent medical services, including arthroscopic surgeries, and receiving compensation disguised as dividends or cash distributions.

Mark Geragos, the Hostin family lawyer, issued a strong statement demanding American Transit issue an apology and dismiss the lawsuit. Geragos expressed that Dr. Hostin deserves compensation for his medical services and damages for reputational harm.

Attorney Daniel Thwaites previously defended Dr. Hostin, describing the lawsuit as a "blanket, scattershot, meritless lawsuit by a near-bankrupt insurance carrier." He emphasized Dr. Hostin's impeccable record and criticized the insurance company's approach.

Legal team claims smear campaign targets celebrity status

Sunny Hostin, who has a background in law, publicly addressed the situation through Page Six. She accused American Transit of exploiting her celebrity status to orchestrate a media smear campaign against her husband.

The couple, married since 1998, resides in a 10-bedroom estate in Purchase, New York, with their two children. Their relationship began at a church in Maryland, where Dr. Hostin completed his medical education at Johns Hopkins University School of Medicine.

American Transit, which primarily insures taxi and ride-share vehicles, alleges widespread insurance fraud stemming from New York State's No-Fault Law. The company claims the law's substantial payouts have incentivized healthcare providers to over-diagnose, over-treat, and over-bill patients.

Mounting pressure affects medical fraud investigation

Dr. Hostin must respond to the legal complaint by February 10. The case specifically alleges his involvement with Empire State Ambulatory Surgery Center, where he supposedly received payments characterized as illegal kickbacks for patient referrals.

The insurance company cited examples from January 2023, claiming Dr. Hostin performed arthroscopic surgeries on two patients involved in low-impact collisions without exploring conservative treatment options first. These procedures were allegedly unnecessary for soft-tissue injuries.

Attorney William Natbony, representing American Transit, emphasized the significance of addressing no-fault fraud in New York. However, defense lawyer Steven Harfenist suggested the lawsuit might be a desperate attempt to eliminate receivables by targeting smaller practices that cannot afford lengthy litigation.
